These Terms and Conditions of Sale govern all sales made through the website www.junglebox.fr.

By placing an order on the website, the customer confirms that they have read and accepted these Terms and Conditions of Sale without reservation.

2. Scope

These Terms and Conditions of Sale, hereinafter referred to as the “Terms”, apply to all sales concluded through www.junglebox.fr between JungleBox and its customers.

They apply in particular to the sale of:

  • live tropical plants;

  • bromeliads;

  • mosses and other plant material;

  • substrates;

  • natural decorative materials;

  • terrarium and paludarium equipment;

  • misting and irrigation systems;

  • lighting equipment;

  • terrariums and glass products;

  • kits and accessories;

  • and any other products offered for sale by JungleBox.

The essential characteristics of each product are described on the relevant product page.


3. Products and Availability

The products offered for sale are those displayed on www.junglebox.fr, subject to availability.

JungleBox reserves the right to modify its catalogue and product availability at any time.

If a product becomes unavailable after an order has been confirmed, JungleBox will inform the customer as soon as possible and may offer, depending on the circumstances:

  • an equivalent product;

  • a credit note;

  • or a refund for the unavailable product.

Live Plants and Natural Products

Plants and natural materials are unique and evolving products.

Product photographs are provided for illustrative purposes. Unless expressly stated otherwise, the exact plant shown in a photograph may not be the plant supplied.

Natural variations may include:

  • size;

  • shape;

  • number of leaves;

  • colour;

  • leaf patterns;

  • presence of new growth;

  • root appearance;

  • general morphology.

Such natural variations do not in themselves constitute a defect or lack of conformity.

The same applies to natural products such as cork, roots, branches, bark, stones and other natural decorative materials, whose appearance, colour and dimensions may vary.


4. Prices

The applicable prices are those displayed on www.junglebox.fr at the time the order is confirmed.

Prices are shown in euros.

Where JungleBox benefits from the French VAT exemption scheme, the following statement applies:

“VAT not applicable – Article 293 B of the French General Tax Code.”

Delivery charges are not included in the product price unless expressly stated otherwise.

JungleBox reserves the right to change its prices at any time. However, products will be invoiced at the price displayed at the time the order is confirmed.

An obvious pricing or display error resulting, for example, from a technical issue does not require JungleBox to supply a product at a manifestly incorrect price.


5. Orders

The customer selects the products they wish to purchase and adds them to their shopping cart.

Before confirming the order, the customer must check:

  • the selected products;

  • quantities;

  • billing address;

  • delivery address;

  • delivery method;

  • and total order amount.

Confirming the order constitutes acceptance of these Terms and Conditions.

The order becomes final once payment has been confirmed, subject to product availability.

An order confirmation is sent to the email address provided by the customer.

JungleBox reserves the right to refuse or cancel an order for legitimate reasons, including:

  • payment issues;

  • suspected fraudulent orders;

  • clearly incorrect delivery information;

  • unresolved previous payment disputes;

  • or abnormal orders.


6. Payment

Orders may be paid using the payment methods offered on www.junglebox.fr at checkout, including where available:

  • credit or debit card;

  • bank transfer;

  • PayPal;

  • or any other payment method offered on the website.

Orders are normally prepared only after payment has been confirmed, unless specific payment terms have been agreed in writing with JungleBox.

For bank transfers, order processing may be postponed until the funds have been received.


7. Delivery and Shipping Charges

7.1 Delivery Address

Products are delivered to the address supplied by the customer when placing the order.

The customer is responsible for ensuring that the information provided is accurate and complete.

If a parcel must be reshipped because of an incorrect or incomplete address supplied by the customer, additional shipping costs may be charged.


7.2 Free Delivery from €59 – Maximum Weight of 2 kg

The “Free delivery from €59” offer available on JungleBox applies only to orders meeting both of the following conditions:

minimum order value of €59 and total parcel weight of no more than 2 kg, for eligible destinations and delivery methods displayed on the website.

Orders Over 2 kg

Where the total order weight exceeds 2 kg, full free delivery no longer applies, even where the order value exceeds €59.

In this case, the customer will be asked to pay a contribution towards shipping costs.

JungleBox nevertheless covers part of the actual transport cost, so the customer only pays part of the total delivery charge.

The amount payable by the customer is clearly displayed before final confirmation and payment of the order.

This applies in particular to orders containing:

  • several bags of substrate;

  • heavy products;

  • bulky decorative materials;

  • roots or large pieces of cork;

  • terrariums;

  • glass products;

  • or any product requiring special transportation.


7.3 Preparation and Delivery Times

JungleBox takes particular care when preparing and packaging orders.

The delivery timeframe shown during checkout generally includes both preparation time and the carrier’s estimated transportation time.

Carrier delivery times are estimates unless a specific binding delivery date has been expressly agreed.

Mandatory consumer protection rules applicable to distance selling remain fully applicable.


8. Special Shipping Conditions for Live Plants

As plants are living organisms, they require special handling and packaging.

JungleBox adapts its packaging as far as reasonably possible to the type of plant being shipped and the expected transportation conditions.

The customer acknowledges that a plant may experience minor stress during transportation.

This may include:

  • slight temporary wilting;

  • slightly bent leaves;

  • loss of a few older leaves;

  • minor marks caused by contact with packaging;

  • temporary reactions to changes in temperature or light.

Such temporary effects do not necessarily constitute a defect where they do not materially affect the plant’s health or ability to recover.

Extreme Temperatures

JungleBox may postpone the shipment of live plants when weather conditions present a significant risk to their survival, including:

  • freezing temperatures;

  • extreme heat;

  • or significant temperature conditions along the delivery route.

This measure is intended to protect the plants and reduce transport-related losses.


9. Receipt and Claims Concerning Live Plants

Customers are advised to open parcels containing live plants promptly after delivery and check the condition of the plants.

If a plant is received in a clearly damaged condition, the customer should contact JungleBox as soon as possible after delivery.

To facilitate assessment of the claim, the customer should ideally provide:

  • the order number;

  • a photograph of the parcel;

  • a photograph of the internal packaging;

  • several photographs of the affected plant;

  • and a description of the issue.

JungleBox will assess each case individually and may, depending on the circumstances and applicable legal obligations, offer:

  • plant recovery advice;

  • replacement;

  • a credit note;

  • or a refund.

These reporting procedures are intended to facilitate claims handling and do not affect the customer’s statutory rights.


10. Terrariums, Glass Products and Heavy-Goods Shipping

Terrariums and glass products require specific transportation arrangements due to:

  • their weight;

  • their size;

  • their fragile nature;

  • and the risk of glass breakage during transportation.

Terrariums concerned are therefore shipped using a transport service suitable for heavy and/or bulky goods, with reinforced protective packaging.

€15 Transport Insurance

Relevant terrarium shipments include a specific €15 transport insurance charge, which includes cover for the risk of glass breakage during transit, subject to the terms and limits of the carrier and insurance policy.

This amount is clearly shown to the customer before final confirmation of the order.

This insurance is intended to facilitate the handling of transport damage claims and does not limit or replace the customer’s statutory rights against JungleBox.


10.1 Inspection Upon Delivery

Due to the fragile nature of terrariums and glass products, customers are strongly advised to carefully inspect the parcel and terrarium upon delivery.

If there are signs of:

  • torn packaging;

  • significant impact damage;

  • crushed packaging;

  • sounds of broken glass;

  • broken panes;

  • or any other obvious damage,

the customer should make specific written reservations with the carrier or, where appropriate, refuse the shipment.

A general statement such as “subject to unpacking” is less useful than a precise description of visible damage.


10.2 Broken or Damaged Terrariums

If glass breakage or damage is identified, the customer should contact JungleBox as soon as possible.

To allow JungleBox to open a claim with the carrier and insurer, the customer should, where possible, retain:

  • the external packaging;

  • all internal protective materials;

  • the damaged product.

The customer should also provide:

  • the order number;

  • a photograph of the complete parcel;

  • photographs of any visible impact damage to the packaging;

  • photographs of the internal protective packaging;

  • several photographs of the damaged terrarium;

  • and a photograph clearly identifying the broken pane or damaged component.

These steps help JungleBox process transport and insurance claims.

They do not remove or reduce the consumer’s statutory rights where the product was already damaged at the time of delivery.


11. Right of Withdrawal

Where the statutory right of withdrawal applies, consumers generally have 14 days from receipt of the goods in which to exercise that right without having to provide a reason.

The customer must inform JungleBox of their decision to withdraw by means of a clear statement sent to:

Eligible goods must be returned in a condition suitable for resale and with any accessories supplied with them.

Unless otherwise required by law or expressly accepted by JungleBox, the direct cost of returning the goods is borne by the customer.


11.1 Exception for Live Plants and Perishable Products

In accordance with Article L.221-28 of the French Consumer Code, the statutory right of withdrawal does not apply, in particular, to the supply of goods liable to deteriorate or expire rapidly.

This exception may apply to live plants and other living plant material whose characteristics make them liable to deteriorate rapidly, as well as certain other live or highly perishable products sold by JungleBox.

Where this exception applies, the customer may not exercise the 14-day right of withdrawal merely because they have changed their mind.

This exclusion does not affect the customer’s rights where the product is delivered damaged, defective or non-compliant.


11.2 Personalised Products

The right of withdrawal may also be excluded for goods made to the consumer’s specifications or clearly personalised, in accordance with applicable French consumer law.

This may include certain JungleBox products, installations or terrariums specially produced or arranged according to the customer’s individual requirements.


12. Returns

Customers are advised to contact JungleBox before returning any product:

Returned products must be suitably packaged and protected against damage during transportation.

Where the customer organises the return shipment, they are responsible for properly preparing the parcel.

For particularly fragile, heavy or bulky products, JungleBox may provide specific return instructions depending on the reason for the return and the applicable legal requirements.


13. Statutory Guarantees

Products sold by JungleBox benefit from all statutory guarantees applicable under French law.

These include, where applicable:

  • the legal guarantee of conformity;

  • the legal guarantee against hidden defects.

These statutory guarantees apply independently of any commercial warranty that may be offered by JungleBox.

Nothing in these Terms is intended to exclude or restrict statutory consumer rights.


14. Product Use and Liability

Customers are responsible for selecting products that are appropriate for their intended use and for using them in accordance with:

  • their intended purpose;

  • the product information provided;

  • any instructions supplied;

  • and applicable safety requirements.

Electrical equipment, pumps, misting systems, lighting and other equipment must be installed and operated in accordance with the manufacturer’s instructions.

Subject to mandatory legal provisions, JungleBox cannot be held liable for damage caused by:

  • incorrect installation;

  • misuse;

  • unauthorised modification;

  • lack of maintenance;

  • or use clearly inconsistent with the product’s intended purpose.


15. Advice Concerning Plants and Terrariums

Any advice provided by JungleBox regarding:

  • plants;

  • lighting;

  • watering;

  • humidity;

  • substrates;

  • misting;

  • or terrarium setup,

is based on the information available to JungleBox and on the conditions described by the customer.

Successful plant cultivation depends on many external factors, including:

  • temperature;

  • humidity;

  • water quality;

  • lighting;

  • ventilation;

  • substrate;

  • fertilisation;

  • acclimatisation;

  • pests;

  • maintenance and care.

JungleBox cannot therefore guarantee the indefinite growth or survival of a plant after delivery where deterioration results from subsequent growing or maintenance conditions.

This clause does not limit the customer’s statutory rights concerning the condition and conformity of the plant at the time of delivery.


16. Force Majeure and External Events

JungleBox shall not be held liable for failure to perform its obligations where such failure results from an event meeting the legal requirements of force majeure.

Events which may temporarily affect preparation or transportation include:

  • exceptional weather conditions;

  • major transport network disruption;

  • natural disasters;

  • government or administrative measures;

  • or events reasonably beyond JungleBox’s control.

Mandatory consumer rights remain unaffected.


17. Personal Data Protection

Personal information provided by customers may be used in particular to:

  • process orders;

  • process payments;

  • prepare and ship products;

  • communicate with customers;

  • provide after-sales support;

  • comply with legal and accounting obligations.

Personal data is processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

Any unauthorised reproduction or use is prohibited unless JungleBox has given prior permission or such use is otherwise permitted by law.

The mediator must be a recognised consumer mediator competent for JungleBox’s business activity.


21. Applicable Law and Disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, customers are encouraged to contact JungleBox first in order to seek an amicable resolution.

If no amicable settlement or mediation is successful, the matter may be brought before the competent court in accordance with the applicable rules of jurisdiction.

Nothing in these Terms is intended to deprive a consumer of any mandatory jurisdiction or consumer protection rights available under applicable law.


22. Business Customers

Where the customer is acting for professional or business purposes, specific commercial terms may be agreed with JungleBox, including terms relating to:

  • professional pricing;

  • minimum quantities;

  • discounts;

  • payment terms;

  • delivery charges;

  • special orders;

  • and delivery arrangements.

Where a quotation or specific terms have been expressly accepted by a business customer, those terms supplement these Terms and Conditions and prevail in the event of a conflict concerning the relevant matter.


23. Changes to These Terms and Conditions

JungleBox reserves the right to amend these Terms and Conditions at any time, in particular to reflect:

  • changes in legislation or regulations;

  • changes to services offered;

  • or changes to payment and delivery arrangements.

The applicable Terms and Conditions are those accepted by the customer at the time the order is confirmed.


24. Acceptance of the Terms and Conditions

By confirming an order on www.junglebox.fr, the customer confirms that they:

  • have read these Terms and Conditions of Sale;

  • have received the necessary information before purchasing;

  • and accept these Terms and Conditions without reservation.
